As attorneys, we must deal with questions about the capacity of our clients to execute legal documents, including Powers of Attorney. We need to determine whether clients have sufficient capacity or not and what tools might help with this determination. This course will discuss what capacity is and what some considerations are for determining capacity from a medical and legal standpoint. Examples will be included.
